Purpose
This checklist helps Lower Columbia College (LCC) programs and departments ensure compliance with federal civil rights laws, including Titles VI, VII, and IX of the Civil Rights Act and related federal guidance. It ensures LCC's programs remain open and inclusive while aligning with LCC's continued commitment to diversity, equity, and inclusion (DEI).
Program Review Checklist
1. Eligibility Criteria
- Eligibility is not limited by:
- Race, color, national origin, or shared ancestry.
- Sex (including gender identity, pregnancy, or sexual orientation.
- Criteria such as "first generation," "low income," or "economically disadvantaged" are not used as proxies for race or sex.
- If limited by a grant or statute, legal authority is documented and reviewed by the Civil Rights Compliance Officer.
2. Inclusive Communication
- Name and description of the program clearly state it is open to all.
- Website, flyers, and outreach efforts prominently communicate inclusion.
- Any specific goals (e.g. increasing participation of underrepresented froups) are clearly stated without exclusion.
- Program is not marketed in a way that discourages participation by any protected group.
3. Selection and Decision Criteria
- Race, sex, or other protected characteristics are not used as a factor in selection.
- A documented, neutral, and consistent process is used for decision-making.
- "Diverse slate" requirements or demographic quotas are not used.
4. Conduct and Participation
- Program actions demonstrate a genuine openness to all participants.
- The environment is free from stereotyping or exclusion based on protected characteristics.
- Segregated sessions or spaces based on races or sex are not used.
- If the program addresses DEI or affinity topics, participation is voluntary and open to all.
5. Documentation and Oversight
- Selection criteria, outreach efforts, and participant demographics are documented for transparency.
- Contracts and partnerships include nondiscrimination clauses.
- Federal funds are not used to support third-party discriminatory practices.
- There is a mechanism to review and update materials to ensure compliance.
6. Reporting and Retaliation Protections
- Staff and students are informed of their rights and reporting channels.
- There is a clear anti-retaliation policy in place.
- Concerns about discrimination or exclusion can be reported confidentially.
Examples of Inclusive Language
- "This opportunity is open to all eligible individuals regardless of race, sex, or other identity."
- "While this event focuses on the experiences of [group], it is open to everyone."
- "Our goal is to enhance access for underrepresented populations. All are encouraged to apply."
